"再等等,客户说下个月付。"——这句再等等,可能是追收失败的第一步。欠款追收有明确的黄金窗口,错过一个,难度和成本就上一个台阶。本文拆解三个关键窗口,以及每个窗口应该做的动作。
窗口一:逾期后30天内——黄金沟通期
刚逾期时,债务人通常还在正常经营,现金流问题刚开始显现。这个阶段:
- 双方关系还在,协商空间最大;
- 债务人未及转移资产,保全价值最高;
- 证据新鲜,沟通记录容易补全。
行动清单:书面确认欠款金额与原因;约定明确的付款时间表;为后续可能的法律程序留下证据。30天内解决不了的,立即升级手段。
窗口二:债务人经营恶化前——资产保全期
很多欠款最终收不回来,不是因为没有判决,而是因为债务人已经没钱了。一旦债务人出现以下信号,追收窗口正在关闭:
- 停止回复、频繁更换联系人;
- 大量裁员、停业、拖欠员工工资;
- 股东/高管变动,公司主体变更;
- 财产被其他债权人查封、被起诉记录增多。
行动清单:立即做资信与资产调查;考虑申请财产保全(冻结账户、查封资产);必要时同步向其他债权人了解情况——先到先得,后到的一分钱都分不到。
窗口三:时效届满前——权利存续期
诉讼时效届满后,债权将丧失胜诉权(债务变为自然债务)。各法域时效不同,常见2–6年。关键点:
- 时效从"知道或应当知道权利受损"起算;
- 书面催款、债务人书面确认、部分还款都可能中断/重算时效;
- 在时效届满前启动程序或取得书面确认,是保住权利的最低成本动作。
行动清单:先确认时效状态;必要时以律师函/书面确认中断时效;时效紧张时优先立案。
为什么越早行动越有利:数据逻辑
- 逾期6个月内采取法律行动的债权,回款概率显著高于逾期1年以上的债权;
- 财产保全在债务人资产充裕时申请,成功率远高于其资不抵债之后;
- 每一轮"再等等",都在给对方转移资产、注销主体、拖过时效的时间。
给企业主的三个实操建议
- 把"逾期天数"纳入应收账款管理:30天、60天、90天分别对应不同动作(提醒→律师函→法律程序);
- 逾期即建档:任何一笔逾期款都建立档案,含合同、凭证、沟通记录;
- 重大欠款第一时间咨询:金额大、涉及跨境、债务人有异常迹象的,不要自己扛。

The Golden Window for Debt Recovery: Act Early
"Let's wait — the client says they will pay next month." That wait may be the first step toward a dead debt. Debt recovery has clear golden windows, and each missed window makes recovery harder and costlier. Here are the three windows and what to do inside each.
Window 1: Within 30 days of default — the negotiation window
At the start of a default, the debtor is usually still operating and cash-flow problems are just emerging. At this stage:
- The relationship is intact and there is the most room to negotiate;
- Assets have not been moved — preservation value is highest;
- Evidence is fresh and communication records are easy to complete.
Action list: obtain a written acknowledgment of the amount and reason; agree a concrete payment schedule; preserve evidence for any later proceedings. If it is not resolved within 30 days, escalate.
Window 2: Before the debtor's position deteriorates — the preservation window
Many debts are unrecoverable not for lack of judgments, but because the debtor no longer has money. Watch for these signals that the window is closing:
- No replies, changing contacts;
- Mass layoffs, closure, unpaid wages;
- Shareholder or director changes, entity restructuring;
- Property seized by other creditors, rising litigation records.
Action list: run credit and asset checks immediately; consider asset preservation (freezing accounts, seizing assets); talk to other creditors — first in line gets paid, latecomers get nothing.
Window 3: Before the limitation period expires — the rights window
Once the limitation period passes, the claim loses its enforceability. Limits vary by jurisdiction, commonly 2–6 years. Key points:
- The clock runs from when the claim accrued (or when the creditor knew of it);
- Written demands, written acknowledgments, and partial payments may interrupt or restart the clock;
- Starting proceedings or obtaining a written acknowledgment before expiry is the cheapest way to keep your rights.
Action list: confirm limitation status first; interrupt the clock with a lawyer's letter or written confirmation if needed; file promptly when time is short.
Why early action wins
- Claims pursued within 6 months of default recover at significantly higher rates than claims over a year old;
- Preservation filed while the debtor is solvent succeeds far more often than after insolvency;
- Every round of "waiting" gives the debtor time to move assets, dissolve the entity, or run out the clock.
Three practical suggestions
- Build overdue days into receivables management: 30/60/90 days trigger different actions (reminder → demand letter → proceedings);
- Create a file the day a payment goes overdue: contract, vouchers, communication records;
- Consult early on material debts: large, cross-border, or suspicious situations should not be handled alone.
