策略1:立刻固定债权与证据
- 整理全部合同、借据、订单、对账确认单、付款与催款记录,固定欠款本金与利息;
- 对"跑路"前的沟通(催款、承诺还款)留存证据,防止对方事后否认;
- 确认诉讼时效起算点,避免因时效届满丧失胜诉权。
策略2:开展资产与行踪调查
- 通过公开渠道与合法信息源查找债务人是否在国内/境外留有房产、车辆、股权与存款;

Last week they were still discussing a repayment plan; this week calls go unanswered, the office is locked, and staff have disappeared. A debtor vanishing is one of the trickiest and most common scenarios in both domestic and cross-border recovery. The real danger is not just that the money is temporarily unavailable — it is that you watch the limitation period slip away, evidence scatter, and assets move, until even the chance to sue is lost. Move through these six strategies early and in order.
Strategy 1: Fix the claim and the evidence now
- Organize all contracts, IOUs, purchase orders, account confirmations, payment records, and demand history; fix the principal and interest.
- Keep evidence of pre-disappearance communications (demands, promises to pay) so the debtor cannot later deny liability.
- Confirm when the limitation period runs, to avoid losing the right to sue.
Strategy 2: Investigate assets and whereabouts
- Use lawful, public sources to find any property, vehicles, equity, and deposits the debtor holds at home or abroad.
- Check whether the debtor has re-registered, or holds assets through related companies and family members (mind separate legal personality).
- Where necessary, engage qualified investigators and counsel for background and asset mapping — act fast.
Strategy 3: Apply for preservation
- Once asset leads appear, apply promptly for preservation (freezing accounts, sealing property) to prevent transfer or disposal.
- Preservation usually requires security; the amount and ratio follow the accepting court.
- Preservation is a race against time — the shorter the gap between finding a lead and filing, the better.
Strategy 4: Pursue related parties
- If the debtor is a company and shareholders have stripped capital or mixed the company's assets, assess piercing or shareholder liability.
- Bring parents, guarantors, or actual controllers into scope to widen the executable asset pool.
Strategy 5: File a criminal complaint in parallel
- For non-payment of wages, contract fraud, or fundraising fraud, report to the police and seek case filing and prosecution.
