Legal Expense Insurance: What It Covers
When collecting a debt, the real fear is not losing — it is "winning and still losing money", because legal fees, arbitration costs, preservation fees and travel can swallow part or all of the claim. Legal Expense Insurance (LEI) exists to shift this "cost of litigating" risk to an insurer. But it is not "buy it and sue freely" — what it covers, what it excludes, and when it is triggered all need to be understood.
What legal expense insurance actually covers
LEI typically covers the reasonable lawyer fees and procedure costs you incur as the insured in legal proceedings. Common directions include:
- Contract / debt collection: costs of pursuing collection, arbitration or litigation against a non-paying counterparty;
- Employment / tenancy / other disputes: personal employment and tenancy disputes, depending on the product line;
- Losing-party costs: some policies cover costs you are ordered to pay or security for costs.
Products differ greatly across countries, and the exact scope, limits and exclusions always follow the policy wording.
Common exclusions
- Disputes arising before cover starts: almost all LEI excludes losses known or existing before you took out the policy — the very reason it rewards buying early;
- Frivolous or hopeless claims: insurers assess chances of success; claims with no reasonable prospect are not accepted;
- Criminal fines, intentional acts, punitive damages: usually outside ordinary civil LEI;
- Amounts beyond limits or outside the designated panel: some products restrict your choice of counsel or require advance approval.
Practical points
1. Buy before the dispute arises. The core value of LEI is shifting future litigation risk away; once a dispute has surfaced, cover for its costs will almost always be refused.
2. Take underwriting seriously. Insurers assess the strength of your evidence, the debtor, and the odds of success. Solid materials win better limits and terms — complete contracts and correspondence are a prerequisite.
3. Clarify triggers and reporting. When to trigger (advance approval?), how to appoint panel counsel, and how fees are paid or reimbursed must be confirmed at placement.
4. Use it alongside other tools. Pair LEI with export credit insurance, factoring and receivables management for a fuller collection-risk framework.

Risk notes
- The worst move is buying only when trouble hits: costs for an existing dispute are virtually uninsurable — early purchase is what works;
- Do not assume it is "comprehensive": exclusions, limits, panel counsel and a merits threshold may all apply — read every clause;
- Do not exaggerate to get covered: material misstatements at application can void a claim;
- Do not ignore market differences: LEI is well developed in Germany, the UK and parts of Europe but limited elsewhere — assess your market.
