Collecting from US Buyers: From Demand to Lawsuit
Your goods shipped, and the US buyer stalls with "quality issues," "tight cash flow," "payment not approved yet." International orders are large with long payment terms, and the buyer sits in another time zone under another legal system—recovering across the Pacific feels impossible. The longer you avoid formal steps, the more the buyer assumes you "will not follow through," and the debt ages. US collection follows a clear path: build a written file, send demand letters, negotiate settlement and guarantees, then if needed pursue small claims or state court. Getting each step right turns a bad debt into an enforceable right.
Step 1: fix the evidence, build a written file
- Organise the sales contract/PO, invoices, shipping documents, signed receipts, reconciliations, and email threads; note payment terms, due date, governing law, and the dispute clause;\
- Send a formal written demand by trackable means (email plus courier) stating the amount, due date, interest, and a final grace period;\
- Watch the limitation period (varies by US state, usually several years, per contract governing law) so it does not lapse while you negotiate.
Step 2: negotiate and secure guarantees before any court
- If the buyer still operates and the dispute is about amount, agree staged repayment or a guarantee, reduced to a written settlement;\
- Have local US counsel issue demand letters and apply settlement pressure—many US buyers take matters seriously only after a formal attorney letter;\
- Make the settlement state defaults, an acceleration clause, and chosen forum to prevent a second default.
Step 3: pick a litigation route you can win
- Smaller amounts (state caps differ, often a few thousand dollars): small claims—simple and low cost, but usually no attorney and limited enforcement;\
- Larger amounts: sue in US state court, typically with local counsel, claiming the debt, interest, and possibly attorney fees;\
- Check whether the contract has arbitration or an exclusive forum clause; if so, follow it first and do not miss procedural prerequisites.
Step 4: enforcement after judgment
- A judgment alone is not money—enforcement follows the debtor's assets, via wage garnishment, bank account freeze, or property sale;\
- If the debtor also has assets in China or elsewhere, assess recognition and enforcement locally.
Time and cost expectations
| Stage |
Typical timeline |
Main costs |
| Evidence and demand letter |
Days to weeks |
Low (consult/letter fee) |
| Negotiation and settlement |
Weeks to months |
Counsel fees (fixed quotes possible) |
| Small claims |
Usually months |
Filing fees + modest counsel cost |
| State court to judgment |
Usually 6–18 months |

| Enforcement |

Enforcement counsel + court costs |
These are experience ranges, depending on amount, cooperation, and state. We do not promise results, but whether you claim and preserve in writing early often decides recovery.
Key risks
- Do not rely only on verbal reminders—you lose leverage and evidence;\
- Cross-border litigation mixes US state law, evidence rules, and Chinese law; when unsure, follow local law and professional advice;\
- Be wary of "guaranteed recovery" pitches; US litigation has many variables—ask for the path and fees in writing;\
- For key orders, address dispute resolution and cost-shifting in your contract so collection has a solid footing later.
