第1步:确认继承方式与继承人范围

Your parents' apartment in China is registered in the deceased parents' names, while you live overseas long-term. You want to complete the inheritance transfer but do not know where to begin: notarize the succession first, or go to the land registry? How should your foreign-issued documents be authenticated? And if you sell, how do you legally remit the proceeds? Many people spend the better part of a year, only to have documents rejected repeatedly because steps were done out of order or key papers were missing. In property inheritance, getting the sequence wrong stalls everything downstream.
Step 1: Confirm the succession route and the heirs
- If there is a will, confirm its validity and proceed by testate succession; otherwise follow the statutory order and identify all heirs.
- Verify each heir's nationality or residence, marriage, and children, and decide who must appear in person or may be represented.
- If heirs agree on who takes the property, settle the split before proceeding.
Step 2: Notarize and authenticate foreign documents
- Identity documents, death certificates, and kinship certificates issued abroad usually need notarization plus consular legalization or an apostille.
- Confirm the required number of sets with the registry in the property's location beforehand.
- Provide Chinese translations; translations are usually also required from qualified providers.
Step 3: Obtain a succession certificate where required

- All heirs confirm acceptance or waiver at the notary, in person or through a compliant process.
- If an heir cannot appear, complete a power of attorney and authenticate it.
Step 4: Apply for the ownership transfer
- Take the succession certificate, authenticated documents, the original title deed, and identity papers to the local real estate registry to apply for the transfer.
- Once verified, title is changed to the heirs and a new certificate issues.
- Practice varies by locality; pre-confirming the document list helps avoid rejections.
Step 5: Tax and FX matters if selling
- The inheritance step itself normally does not attract a separate "inheritance tax" in China; the main items are deed tax and registration fees, subject to local rules.
- If you sell the inherited property, monitor income tax and related liabilities; the taxable basis follows current policy.
- To remit sale proceeds abroad, follow the purchase-and-remittance procedures and provide the bank with inheritance and tax-payment documents.
