Step 1: distinguish "inheritance claims" from "partitioning the estate"
- Inheritance-dispute claims (confirming heirship, dividing the estate) are subject to a limitation period: under Chinese law, generally three years from when you knew or should have known your rights were harmed and who the obligor is;
- Where the estate was never divided and remains held in common by all heirs, some cases are treated as not yet time-barred, but practice varies by locality;
