Legal Ways to Find US Real Estate and Bank Accounts
Suspect a debtor owns US property or bank accounts? Here are the lawful ways to trace assets via public records, court processes, and counsel tools before enforcement.
- 不动产(房产):美国大多县(county)有公开的房地产记录(deed records),可按姓名或地址检索房产、抵押与产权档案。只要你有债务人的准确姓名或已知地址,常能查到名下房产;
- 企业备案:各州州务卿(Secretary of State)网站可查公司注册、股东、董事与注册代理信息,适合穿透债务人名义下的空壳公司;
- 获得生效判决后,可通过债权人质询(post-judgment discovery / debtor's examination)要求债务人披露其银行、收入与资产;
- 可通过法院签发第三方传票向银行调取账户信息;
- 美国执业律师可发起审前或审后发现程序(discovery),依法传唤证人、调取文件;
- 律师事务所常配备持牌调查资源,通过合规渠道(公开记录、行政数据)做资产"画像";
- 若最终目的金额大、在美国执行,务必先在中国取得可执行的裁判文书,并按美国法律申请承认与执行(视州而异);
- 不要购买所谓"银行内鬼"或他人隐私信息——在美国这是刑事重罪,也毁掉证据合法性;
- 不要仅凭公开记录就武断认定"债务人没钱"或"瞒报",需多源交叉核验;
- 不同州对证据调取、询问与扣押程序规定不同,务必以当地法律及专业意见为准;

Legal Ways to Find US Real Estate and Bank Accounts
A debtor owes you money and keeps delaying, yet seems to have just bought a house in the US and parked profits in overseas accounts. You want to trace those assets, but the old "unofficial insider" approach does not work in the US — misuse of back-channels can cross legal lines. The good news: the US is quite open about asset information. Real property records, litigation records, and corporate filings are largely public. The key is knowing where to look, what to look for, and which steps must go through a court or lawyer. Here is a lawful US asset-tracing path.
Route 1: start with public records (cheapest)
A great deal of US asset information is public by default:
- Real estate: most US counties maintain public property records (deed records), searchable by name or address, covering ownership, mortgages, and title filings. With the debtor's full name or a known address you can often locate owned property;
- Corporate filings: each state Secretary of State publishes registration, shareholder, officer, and registered-agent data online — useful for piercing a shell company held in the debtor's name;
- Litigation records: PACER lets you search federal cases, and many state courts offer public online case lookups, which may reveal prior disputes and judgments involving the debtor.
Route 2: bank accounts — go through the legal process
Bank accounts are not publicly searchable the way property is, so "just checking with the bank" is generally not lawful. Use proper procedures:
- After obtaining a judgment, use post-judgment discovery / a debtor's examination to require disclosure of bank accounts, income, and assets;
- Obtain a third-party subpoena from the court to request account records from a bank;
- Some states allow post-judgment garnishment / levy against accounts, but only through that state's procedure.
Route 3: engage counsel and professional investigation
- A US-licensed lawyer can run pre- or post-judgment discovery, lawfully compelling testimony and documents;
- Law firms often work with licensed investigative resources to build a compliant asset "profile" from open records and administrative data;
- Note the difference: private investigators may collect only publicly available information lawfully. Anyone offering "insider access to bank statements" is usually unreliable.
Route 4: cross-border support and enforcement handoff
- If the amount warrants US enforcement, first obtain an enforceable ruling in China and apply for recognition and enforcement in the US (state-dependent);
- When US enforcement is the goal, design the investigation together with counsel in the enforcement state, so the assets you find can actually be attached in the enforcement proceeding.
Time and cost expectations
| Route |
Typical timeline |
Main costs |
| Public record searches (property/company/litigation) |
Days to 2 weeks |
Low (per-search fees at some sites) |
| Secretary of State / court system checks |
1–3 weeks |
Low |
| Post-judgment examination / subpoena |
1–3 months |
Counsel + procedural fees |
| US enforcement (recognition + levy) |
6–18 months, state-dependent |
Counsel + bond/enforcement fees |
These are experience ranges, and outcomes cannot be promised. Tracing lawfully and tracing accurately are half the collection battle.
Key risks
- Do not buy "bank insider" or other private data — this is a felony in the US and destroys evidentiary admissibility;
- Do not conclude from public records alone that the debtor "has nothing" or is "underreporting" — cross-check multiple sources;
- Discovery, examination, and garnishment rules vary by state; local law and professional advice should govern;
- Once assets are found, act promptly on preservation and timing — delay can let executable property slip away.
