Choosing the wrong tool not only fails to recover the money — it can burn the remaining window for preservation and suit. Here is the difference, when each makes sense, and the right path forward.
Step 1: understand the fundamental difference
- A collection agency is essentially a debt-chasing service: in most cases it can only press the debtor by phone, letters, or on-site contact, and it generally lacks the legal authority to sue, apply for preservation, or enforce a judgment;
- A lawyer is licensed to act as counsel: issuing a formal demand letter with legal weight, and handling litigation, arbitration, preservation, and enforcement;
- Key note: regulation of "debt collection" varies widely by country — licensing, fees, and forbidden tactics differ, so verify the agency's legal standing before relying on it cross-border.
Step 2: know when a debtor is beyond an agency's reach
- If the debtor is still operating, willing to talk, and the amount is small, negotiation-style chasing may work;
- But as soon as any of these appear, an agency usually hits its limit: the debtor goes silent, moves assets, winds up the company, argues limitation, disputes the goods, or needs assets frozen — all of which demand litigation and enforcement tools;

- An agency's headline fee may look low, but most charge a share of what is recovered and cannot sue or enforce; when you ultimately need to litigate you would still have to hire a lawyer, paying an extra layer;
- Judge by whether the firm can sue and freeze assets, not by price alone.
