Cases stall at "award in hand, no money received." The good news: mainland China has clear legal channels to recognise and enforce both Hong Kong and Singapore awards. The key is choosing the right legal basis, preparing complete documents, and following procedure correctly, or you risk dismissal on grounds such as procedural defects. Here is a step-by-step breakdown.
Step 1: identify the applicable legal basis
- Hong Kong awards: under the Arrangement between the Mainland and the Hong Kong SAR on mutual enforcement of arbitral awards, apply to the intermediate people's court at the debtor's domicile or property location. \
- Singapore awards: China is a party to the 1958 New York Convention, so awards can be recognised and enforced through the convention route at the competent intermediate people's court. \
- Both routes require that the award is final and not set aside in its seat, so also obtain a certificate of finality from the issuing authority.
Step 2: determine the competent court and prepare documents
- Court: generally the intermediate people's court at the respondent's domicile or the location of executable property; where assets are scattered, choose one location to start. \
- Key documents: the application for recognition and enforcement, the arbitration agreement, the original or certified copy of the award, and Chinese translations—foreign documents usually need notarisation/apostille or a qualified translation. \
- Tip: a missing document can force supplementation and extend the timeline, so prepare everything up front.
Step 3: file the application and follow the review process
- After filing, the court serves the respondent and allows a written defence period. \
