Enforcing US Judgments in Chinese Courts
Won in the US but debtor assets sit in China? Chinese courts recognize foreign judgments on reciprocity. See the path, notarization, timing, uncertainties.

Enforcing US Judgments in Chinese Courts
You won in the United States—judgment in hand—but the debtor has parked its assets in China: a Shanghai account, a Shenzhen apartment. If Chinese courts refuse to recognise the US judgment, you have won only a piece of paper and the money stays out of reach. Recognition and enforcement of foreign judgments in China is not automatic; it rests on reciprocity or a judicial-assistance treaty, and there is no dedicated treaty with the United States. In practice, recognition is assessed case by case and carries real uncertainty. That is why the application demands careful procedural compliance and evidence preparation—one misstep and it all falls apart. Here is an actionable path.
Step 1: assess whether it is recognisable and worth pursuing
- Before filing, assess the reciprocity basis and precedent: has this court or region recognised a US judgment before?\
- In most cases you apply to the competent intermediate people's court in China; acceptance and recognition depend on the particular case;\
- Weigh the debtor's asset location and enforceability against the cost and value of applying.
Step 2: prepare and legalise your documents
- The US judgment, its translation, and supporting documents typically require local notarization and consular legalisation (apostille/certification), professionally translated into Chinese;\
- Prepare proof of finality and procedural soundness of the US judgment (final, enforceable, proper service on the defendant);\
- Show that the debtor holds enforceable assets located in China.
Step 3: file with the competent court
- Under the PRC Civil Procedure Law, file for recognition and enforcement with the intermediate people's court at the debtor's domicile or where the assets sit;\
- Chinese courts review finality, procedural fairness, and consistency with fundamental Chinese law, rather than retrying the merits;\
- Cooperate with the court's requests for supplementary documents and instruct Chinese counsel to liaise during review.
Step 4: enforce once recognised
- After the court recognises and grants enforcement, the case proceeds like any domestic Chinese judgment—account freezes and property seizures become available;\
- If assets are being moved, apply promptly for preservation to secure the enforcement result.

These are experience ranges, depending on complexity, court pace, and debtor cooperation. We do not promise results—whether a US judgment is recognised and enforced in China carries uncertainty and must be assessed case by case.
Key risks
- Do not assume a US judgment is automatically valid in China—recognition depends on reciprocity and case review;\
- Materials without proper legalisation or standard translation may be rejected;\
- Chinese and US law differ on service and finality; when unsure, follow local law and professional advice;\
- Beware "guaranteed enforcement": ask counsel to set out the legal basis and uncertainties in writing.
