You are collecting a debt or arbitrating in Hong Kong or the UK, and the demand letter is signed by a "solicitor," while at the hearing another figure—a "barrister"—appears. Confusion sets in: who is actually working for me? Whose fees am I paying? Get the layers wrong and the most common result is extra rounds of legal bills, a slower case, and your real goal—getting paid—stalls. In common-law systems such as the UK and Hong Kong, the "advocacy" and the "office work" roles are split. Understanding what a solicitor actually does is your first step to saving money and avoiding wasted effort.
Step 1: where the solicitor sits in the common-law system
In common-law jurisdictions, practising lawyers typically fall into two groups:
- Solicitors communicate with the client, review contracts, prepare litigation documents, organise evidence, and liaise with opposing counsel. The solicitor is the one who organises the case and is what you directly instruct;\

Instructing a capable solicitor is a means, not the end. You want an enforceable recovery path—from demand letter, asset investigation, and freezing orders to recognition and enforcement of a judgment or award abroad. When selecting counsel, ask in writing for: a feasibility assessment, expected timeline and fee range, who handles each stage, and a plan for timing and preservation issues.
