The debtor fled abroad and enforcement at home hits a dead end. A playbook: locating assets, choosing arbitration or litigation, freezing and enforcement.

Cross-Border Collection Playbook: Debtor Abroad
Your debtor moved the company offshore, relocated overseas, and stopped answering. Back home, even a court judgment finds no executable assets, so collection hangs in limbo. Cross-border collection is hard because the person is abroad, assets are scattered, and jurisdictions overlap—but it is not hopeless. The key is not to scramble in all directions but to follow a playbook: first map the debtor's identity and asset leads, then obtain an enforceable basis via arbitration or litigation, combine freezing and discovery, and finally enforce where the assets sit. Here is the full path.
Step 1: map—debtor identity and overseas asset leads
- Identify the real identity and registration of the debtor and affiliated entities (companies, offshore structures, spouse/close relative assets); \
- Use public registers, credit checks, due diligence, and commercial and social leads to trace overseas bank accounts, property, and equity; \
- Mapping tells you "where to enforce"; the more specific the leads, the clearer the path.
Step 2: obtain an enforceable basis
- If the contract has an arbitration clause (especially Hong Kong, Singapore, or London), arbitrate there—awards are more easily enforced under the New York Convention across many jurisdictions; \
- Without arbitration, litigate in China or the debtor's location and then seek recognition and enforcement of the judgment; \
- When obtaining the enforceable basis, consider from the start whether it can actually be enforced where the debtor's assets are located.
Step 3: lock down assets with freezing and discovery
- Evaluate applying for a freezing order or preservation early in the proceedings to stop further transfers; \
- Use the court's or tribunal's disclosure process to require the debtor to list actual overseas assets; \
- Where facts matter, use cross-border discovery to obtain transaction records and account flows.
Step 4: enforce where assets sit and coordinate across jurisdictions
- With the enforceable basis in hand, apply for recognition/enforcement at the debtor's or property's location, acting in several jurisdictions in parallel if needed; \
- Work with local counsel to assess practical thresholds, asset types, and realisation difficulty; \
- Enforcement is not one-shot; keep tracking asset movements and progress.
Time and cost expectations
| Stage |
Typical timeline |
Main costs |
| Asset mapping and intelligence |
Weeks to months |
Investigation/credit-check fees |
| Arbitration or litigation |
Usually months |
Arbitration/litigation fees + legal fees |
| Freezing order/discovery |
Days to months |
Legal fees + security arrangements |
| Cross-border recognition and enforcement |
Usually months, by jurisdiction |
Enforcement counsel + execution costs |
These are experience ranges, depending on jurisdiction, amount, and evidence completeness. We do not promise results, but a clearer strategy and more specific asset leads raise the chance of success.
Key risks
- Never rely on promises of "guaranteed recovery" or "inside channels"; results depend on evidence and local practice; \
- Freezing and judgment-recognition thresholds vary by country—follow local law and professional advice; \
- Cross-border runs are long and costly; weigh expected returns before committing; \
- Incomplete notarisation/authentication of evidence and documents stalls enforcement—prepare early.
